These Terms and Conditions (hereinafter referred to as "T&C") govern the mutual rights and obligations between the Seller and the Buyer. They form an integral part of every Purchase Agreement concluded between the Seller and the Buyer through the online store smartlife-eshop.cz (hereinafter referred to as the "E-shop").

The Buyer may be:
a Consumer (a natural person acting outside the scope of their business activity), or
an Entrepreneur (a person acting in the course of their business activity when placing an order).
All contractual relationships are governed by the legal order of the Czech Republic, specifically Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection.
The Buyer may place an order through the E-shop, by e-mail, or by phone. By completing and submitting the order form, the Buyer confirms that they have read these T&C and the Complaints Procedure and agree with them. The button used by the Buyer to submit the order is clearly marked with the text "Order and Pay" or a similar designation that confirms the payment obligation. By submitting the order, the Buyer explicitly confirms that they are aware that the order creates a payment obligation. The Purchase Agreement is concluded at the moment the Seller electronically confirms the acceptance of the Buyer's order to the e-mail address provided by the Buyer during the order. This confirmation includes an order summary and serves as confirmation of the distance contract conclusion. The Buyer is obliged to provide correct, complete, and truthful data necessary for the delivery of the order. The Seller is not responsible for delays or non-delivery in the event of incorrect data provided. The Buyer bears the costs associated with the use of distance communication means (e.g., costs of internet connection, phone calls), provided these costs do not differ from the basic rate charged by their operator/provider. The contract is concluded in the Czech language. The concluded contract is archived electronically and is not publicly accessible.
All prices listed on the E-shop website are final, including VAT and all fees. Prices are valid at the time the order is placed. The Seller reserves the right to change prices without prior notice, but this change does not apply to contracts already concluded. Payment methods:
Bank transfer to the Seller's account,
Payment by invoice with maturity (only for verified Entrepreneur-customers).
Goods are delivered via transport companies to the address specified by the Buyer in the order.
Shipping Costs: The shipping cost is determined individually for each order and will always be consulted and confirmed with the Buyer before the shipment is dispatched. The final cost depends on the size and type of the shipment (e.g., standard carton, pallet shipment) and the agreed delivery method (delivery by the Seller or pick-up by the Buyer/their carrier).
The delivery period is usually 3–7 working days from the order confirmation, depending on the destination and complexity of the shipment. The risk of damage to the goods passes to the Buyer upon taking over the goods from the carrier.
The Consumer has the right to withdraw from the contract within 14 days of taking over the goods without giving a reason. The withdrawal period is maintained if the Consumer sends a notice of withdrawal to the Seller before the expiration of this period. For withdrawal, the Consumer may use a model withdrawal form or an unequivocally formulated statement sent by e-mail to objednavky@smartlife.cz. The goods must be returned to the Seller within 14 days of withdrawal, preferably in the original packaging and with complete accessories. The costs associated with returning the goods to the Seller are borne by the Consumer. The Seller shall refund all payments received, including the cost of delivery (excluding additional costs incurred by choosing a delivery method other than the cheapest standard method offered), no later than 14 days from the receipt of the returned goods. Diminution in Value: The Consumer is liable to the Seller only for the diminution in the value of the goods resulting from handling the goods in a manner other than what is necessary to handle them with regard to their nature and properties (e.g., normal testing of the goods is not considered a diminution in value; damage to the goods is). The right of withdrawal does not apply to (illustrative list): goods modified according to the customer's wishes, goods that cannot be returned for hygienic reasons (e.g., unwrapped health or cosmetic aids).
The Buyer is obliged to check the condition of the shipment upon receipt. In the event of damage to the shipment, the carrier and the Seller must be informed immediately. The warranty period is 24 months from the takeover of the goods (unless stated otherwise). A Buyer who is an Entrepreneur is obliged to claim defects without undue delay after their discovery. For business purchases, liability for defects applies only to defects that the product had at the time of takeover. The Buyer is obliged to present the proof of payment (invoice) or other document proving the date of purchase and identification of the goods along with the defective product. Complaints will be processed no later than 30 days from the date of their application, unless the Seller and the Buyer agree on a longer period. After the futile expiration of this period, the Consumer has the right to withdraw from the contract or demand a reasonable discount. The warranty does not cover defects caused by normal wear and tear, improper use, improper handling, storage, or mechanical damage. In case of an accepted complaint, the Buyer may demand: repair of the product, replacement of the product, a reasonable discount from the price, or withdrawal from the contract and refund of the price.
The Seller processes the Buyer's personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and Act No. 110/2019 Coll., on Personal Data Processing. The data is processed solely for the purpose of contract performance, accounting, and communication with customers. The data is stored only for the necessary period and is not provided to third parties, with the exception of carriers and persons providing accounting or IT services with whom the Seller has concluded processing agreements. The Buyer has the right to access their data, correct it, erase it, limit processing, and raise an objection. The Consumer residing in the Czech Republic has the right to contact the subject of out-of-court consumer dispute resolution. This subject is: Czech Trade Inspection Authority (ČOI), Central Inspectorate – ADR Department, Štěpánská 15, 120 00 Prague 2, Web: www.coi.cz. The Consumer can also use the online dispute resolution (ODR) platform of the European Commission available at
Dispute Resolution: The Parties have agreed that all disputes arising between them based on the Purchase Agreement shall be resolved by the materially and locally competent courts of the Czech Republic. Note for international consumers: This choice of jurisdiction does not apply if the Buyer is a Consumer and has permanent residence in another EU Member State; in this case, the Consumer has the right to file a lawsuit with the court having jurisdiction over their place of residence. These T&C are valid in the version listed on the E-shop website on the day the order is submitted. By submitting the order, the Buyer confirms that they have read these terms and agree with them. Rights and obligations not regulated by these T&C are governed by the Civil Code No. 89/2012 Coll.. The costs associated with the use of distance communication means (e.g., internet, telephone) are borne by the Buyer. These Terms and Conditions shall enter into force on September 1, 2025.
